for contracts for participation in conferences

seminars organized by HOFMANN WIZARD sro
I.
Introductory provisions
- Company: HOFMANN WIZARD sro, ID: 25236016, with its registered office at Prešovská 4, Plzeň , 301 00, registered in the Commercial Register kept by the Regional Court in Pilsen under file number C 11501, (hereinafter referred to as the "organizer"), is a personnel agency.
- These general terms and conditions (hereinafter referred to as the "GTC") are issued by the organizer in accordance with the provisions of Section 1751, paragraph 1 of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code") for the purpose of regulating the mutual rights and obligations arising from the contract for participation in an event organized by the organizer between the organizer and the person who orders a ticket or tickets for an individual event through the registration form available on the organizer's website (hereinafter referred to as the "Orderer"), as well as the person whose name the Orderer states in the order as a participant in the event and who actually participates in the event (hereinafter referred to as the "Participant").
- Information about individual events organized by the organizer is available on the organizer's website hrfresh.cz and also usually on the website set up by the organizer for an individual event, where the organizer publishes announcements about individual conferences. In the announcement of the event, the organizer states in particular the event program, date and venue of the event, the price for participation in the event, the scope of performance provided in connection with participation in the event included in the price, as well as other specific conditions of participation in the event.
II.
Conclusion of the contract
- The organizer makes a call for bids for the conclusion of a contract for participation in the event via its website; the provisions of Section 1732 do not apply in this case. By sending an order via the registration form available on the organizer's website, in which the customer specifies the scope of participation in the event and identifies its participants, the customer makes a proposal to conclude a contract. The order must include all information required by the organizer. The order is binding on the customer.
- The contract for participation in the event is concluded upon acceptance by the organizer, namely by sending a confirmation e-mail to the customer to the e-mail address specified in the order. The organizer is entitled not to conclude a contract for participation in the event.
- By sending an order via the registration form available on the organizer's website, the customer agrees to these general terms and conditions and declares that he has read the Personal Data Processing Policy. In the event that the identity of the customer and the participant does not match, or if the customer orders participation in the event for multiple participants, the customer undertakes to ensure that the participants registered by him are familiar with these General Terms and Conditions and the Personal Data Processing Policy. In the event of a breach of this obligation, the customer is liable for all damage incurred by the organizer in this context, and if the organizer is obliged to provide any performance to a third party as a result of a breach of this obligation of the customer, the customer is obliged to compensate the organizer for the value of such performance. By participating in the event and signing the attendance sheet, individual participants confirm that they have read these General Terms and Conditions and agree to them, and further confirm that they have read the Personal Data Protection Policy.
- Given the nature of the event, neither the client nor the participants are considered consumers within the meaning of Section 419 of the Civil Code, so the provisions on obligations under contracts concluded with consumers do not apply in this case.
III.
Subject of the contract
- The subject of the contract is the organizer's obligation to enable the client or participants specified by the client in the order to participate in the event under the conditions set out in these GTC, or under the conditions set out for participation in a specific event specified in the announcement of the event, to the agreed extent, and the client's corresponding obligation to pay the price for participation in the event in the specified amount properly and on time.
- The content of participation in the event, its program and the performance that will be provided to the client and/or participants as part of participation, results from the announcement of the event, which the organizer publishes on its website and, as a rule, on the websites set up by the organizer for the individual event.
IV.
Payment terms
- The price for participation in the event, as well as the scope of services provided in connection with participation in the event included in this price, are set out in the announcement of the event.
- The price for participation in the event can be paid online via a payment gateway, if the organizer allows this option for the given event, or by bank transfer based on an advance invoice that will be issued by the organizer following receipt of the order. When paying by bank transfer, the customer is obliged to identify the payment in accordance with the instructions sent by the organizer.
- The price for participation in the event is payable within the period specified by the organizer in the confirmation of receipt of the order or advance invoice, but no later than the day of the event.
- Following payment of the price for participation in the event, the organizer will send the customer a confirmation of payment and a tax document to the email address specified in the order.
- In the event of the customer's delay in paying the price for participation in the event or part thereof, the organizer is entitled to withdraw from the contract, even on the day of the event, by written notice sent to the customer to the e-mail address specified in the order. In the event of withdrawal from the contract due to the customer's delay in paying the price for participation in the event, the organizer is entitled to pay a contractual penalty of 60% of the agreed price.

If the participant chooses to pay the event participation fee via a payment gateway, the payment gateway is operated by Comgate, a.s., with its registered office at Gočárova třída 1754/48b, 500 02 Hradec Králové, Company ID No.: 26505244. Within the payment gateway, the following payment methods are available:
- Card payment – after selecting this method, the participant is redirected to a secure payment page where they enter their card details and authorize the payment. Detailed information about card payments can be found here.
- Bank button payment – the participant selects their bank, is redirected to their online banking environment, and confirms the payment after logging in. Detailed information about bank button payments can be found here.

V.
Cancellation of participation in the event
- The customer is entitled to cancel the participation of one or more participants in the event by sending a written notice to the organizer to the e-mail address specified in the order.
- Unless otherwise specified in the conditions for holding an individual event, a cancellation fee of the following amount is charged for cancellation of participation:
- If participation in the event is cancelled no later than 60 days before the event, there is no obligation to pay a cancellation fee;
- If participation in the event is cancelled 59 – 14 days before the event, the cancellation fee is 50% of the price for participation in the event;
- If you cancel your participation in the event less than 14 days before the event, the cancellation fee is 100% of the price for participation in the event.
- A change in the person of the participant is possible after prior mutual agreement between the organizer and the client, and the client is entitled to request such a change no later than 2 days before the event, otherwise the organizer is not obliged to accept the change in the person of the participant.
- The cancellation fee is calculated from the price for participation in the event attributable to those participants whose participation in the event was cancelled.
VI.
Other provisions
- Participation in the event will be allowed only to persons specified by the customer in the order, provided that the price for participation in the event has been duly paid. If the price for participation in the event was paid less than 3 days before the event, the participant is obliged to prove that payment has been made when registering for the event.
- The organizer is entitled to change the date or location of the event, and is obliged to inform the customer of such a change by sending a message to the e-mail address specified by the customer in the order, at least:
- 20 days before the event.
- 14 days before the event.
- 4 days before the online event.
- The organizer is entitled to change the event program. The organizer will inform about any changes to the program by sending a message to the e-mail address specified by the customer in the order, or directly during the event.
- The organizer is entitled to change the form of the event to an online form if, based on a decision by the relevant state authorities, the conditions for holding similar events change.
- The organizer is entitled to require compliance with the conditions for holding similar events set out on the basis of decisions of the relevant state authorities.
- A change in the program, change in the venue, change in the date of the event, or change in the form of the event does not establish the right to withdraw from the contract or the right to a discount on the price for participation in the event.
- The organizer is entitled to take photographs, audio recordings or videos of the participants of the event during the conferences and publish them at its discretion for the purpose of providing information about the event and for the purpose of promotion, in tangible or digital form in all promotional materials of the organizer, both in printed and electronic form. However, when exercising this right, the organizer will always proceed in such a way that the honor, dignity, respect and privacy of the participants are protected to the maximum extent. Photographs, audio recordings or videos may be changed, used as part of a collective work or only a part of them may be used.
- The organizer is entitled to deny entry to the event or prevent the participant from further participation in the event if the participant behaves inappropriately, especially if he/she is under the influence of alcohol or other addictive substances. In such a case, there is no right to a refund of the price for participation in the event.
VII.
Final provisions
- These GTC form an integral part of the contract for participation in the event, which is concluded between the organizer and the client or participant in accordance with the provisions of Article II of these GTC.
- Other conditions of participation in individual events not regulated by these GTC may be set out in the announcement of the event published by the organizer on its website, the same applies to partial changes to individual provisions of these GTC. In the event that the announcement of the event or other conditions of the event with which the organizer informs the client (hereinafter referred to as the "special conditions of the event"), sets the conditions of the event or the contract for participation in the event differently from these GTC, the special conditions of the event will apply to the extent that they contradict each other.
- If any of the provisions of these GTC is or becomes invalid, ineffective or unenforceable, this will not affect the validity, effectiveness and enforceability of the other provisions of these GTC.
- These GTC and the legal relationships arising from them are governed by the law of the Czech Republic, in particular the Civil Code. The courts of the Czech Republic are competent to resolve any disputes arising from the contract for participation in the event.
- These GTC come into force and effect on 01.12.2024
